Representative Nelson moved that the House rescind previous action in adopting Amendment No. 9 (page 1430). The question being: "Shall the House rescind previous action in adopting Amendment No. 9?" Amendment No. 12 was offered by Representative Meyer: Page 175, line 24, following "SUBDIVISIONS": Insert "; PUBLIC EMPLOYEES' RETIREMENT SYSTEM" 2007-05-16 House Journal Page 1442 Page 184, following line 1: Insert new subsections to read: "(d) The sum of $185,000,000 is appropriated from the general fund to the Department of Administration for deposit in defined benefit plan accounts (AS 39.35.100) in the public employees' retirement system as partial payment of the participating public employees' retirement system employers' contribution for the fiscal year ending June 30, 2008. (e) The appropriation made by (d) of this section is intended to be the amount required to set the employer contribution rate of public employees' retirement system employers for the fiscal year ending June 30, 2008, at the lower of the level percentage of pay rate approved by the Alaska Retirement Management Board or 22 percent, but not lower than 14.48 percent." Page 184, following line 21: Insert new bill sections to read: "* Sec. 59. Sections 15(c) and 15(d) of CCS HB 95(Corrected) are repealed. * Sec. 60. CONTINGENCY OF SECTION 59. Section 59 of this Act is contingent on passage by the Twenty-Fifth Alaska State Legislature and enactment into law of CCS HB 95(Corrected)." Renumber the following bill sections accordingly. Page 184, line 15: Delete "sec. 14" Insert "sec. 15" Page 184, line 22, following "29(1),": Insert "55(d)," Page 185, following line 5: Insert a new bill section to read: "* Sec. 63. If, under sec. 60 of this Act, sec. 59 of this Act takes effect, it takes effect immediately under AS 01.10.070(c) but not before the effective date of sec. 15, CCS HB 95(Corrected)." Objection was heard. Amendment to Amendment No. 12 was offered by Representative Meyer: Following "required to set the": Insert "effective" Following "contribution rate of": Insert "all" Representative Meyer moved and asked unanimous consent that Amendment to Amendment No. 12 be adopted. There being no objection, it was so ordered. There being no further objection, Amendment No. 12 as amended was adopted. HCS CSSB 53(FIN) am H was automatically in third reading. Representatives Lynn, Fairclough, Kohring, and Kerttula moved and asked unanimous consent that they be allowed to abstain from voting because of a conflict of interest. Objection was heard, and the members were required to vote. The question being: "Shall HCS CSSB 53(FIN) am H pass the House?" Representative Samuels moved and asked unanimous consent that the roll call on the passage of the bill be considered the roll call on the effective date clause.
